Philly Duck Boat Crash Lawsuit Ends in $17 Million Settlement by noreply@blogger.com (Personal Injury News) 11 May 2012 at 2:49pm After two days of testimony in what was expected to be a trial lasting at least a month, the families of two Hungarian students killed in a tugboat accident on the Delaware River have agreed to a settlement in the case. Szabolcs Prem, 20, and Dora Schwendtner, 16, were visiting the U.S. with a group of students through a church exchange program in July of 2010. The group were touring on the Delaware River on July 7, of that year when their amphibious sightseeing boat, called a duck boat, was slammed by tugboat-guided barge. The duck boat capsized and dozens of people were thrown into the fast-moving Delaware river. The two victims drowned. Their families filed wrongful-death lawsuits against Ride the Ducks, of Norcross, Ga., which operated the tour boat and K-Sea Transportation, of East Brunswick, N.J., which operated the tugboat guiding the barge upriver. In a surprise announcement, the judge in the case approved a $17 million settlement in the case. The families of the two victims will split $15 million while the 18 surviving passengers will split $2 million. Attorney Robert Mongeluzzi, who represents the victims' families, released a statement regarding the settlement on behalf of the families. He said they family members were already on a plane back to Hungary and didn?t even know the settlement had been reached. Once made aware he said, "The families are deeply grateful to the court for recognizing that their children were important and did not deserve to die in vain." Coppa, has been arrested for the neglectful inattention he paid to his elderly mother who suffers from Alzheimer?s disease. Requesting the release of his mother, Coppa was again reminded of the 24-hour care he promised to obtain on his mother?s behalf, at which time he indicated that the issue had already been taken care of. Coben said, "We'll change it from a personal-injury case to a wrongful-death case." Easterling along with a group of seven other former players sued the NFL in Philadelphia in August, claiming the league failed to properly treat players for concussions and tried to conceal for decades any links between football and brain injuries. It was the first potential class-action lawsuit that was filed. Since then, NFLConcussionLitigation.com reports that sixty-one concussion-related lawsuits now have been filed. Easterling, 62, was found dead in his Richmond, Va., home last Thursday. According to Richmond police captain Yvonne Crowder, Easterling?s death was the result of a self-inflicted gunshot wound. Attorney Coben claims his client?s act was a consequence of the concussion problems. He said, "In the last six months, I guess, I could tell he was not on his game. He kept repeating himself and getting confused. It's pretty tough, pretty tough." Easterling, who was found by his wife, Mary Ann, underwent 25 different surgeries during his life, and he was diagnosed with dementia in 2011. She said that over the last 20 years, he had suffered from many of the symptoms common to players of his era, who kept playing through multiple concussions. She said her husband experienced bouts of depression and insomnia, and suffered severe memory loss toward the end of his life. "He had been feeling more and more pain," Mrs. Easterling said. "He felt like his brain was falling off. He was losing control. He couldn't remember things from five minutes ago. It was frightening, especially somebody who had all the plays memorized as a player when he stepped on the field." Easterling's lawsuit, filed by his attorney Larry Coben last August, claimed that the NFL "continuously and vehemently denied that it knew, should have known or believed that there is any relationship between NFL players suffering concussions while playing . . . and long-term problems such as headaches, dizziness, dementia and/or Alzheimer's disease that many retired players have experienced." The NFL has said any allegation that the league intentionally sought to mislead players is without merit. The U.S. Labor Secretary said in a news release that the deaths at the grain elevator could have been prevented if the operators had taken care to address hazards known in the industry. In addition to the 13 citations filed against the grain company, the Occupational Safety and Health Administration is also seeking $406,000 in penalties against Bartlett Grain.Bartlett Grain?s disregard for the law led to the catastrophic incident that devastated the families and agricultural community of the workers who were injured or killed last October. Investigators had previously determined that the grain dust explosion was accidental, but the labor department reinvestigated and found that a lack of proper preventive maintenance and an inadequate emergency plan was to blame.
